Eligibility for Permanent Partner Visa (Subclass 100):
To qualify for the Permanent Partner Visa (subclass 100), you must:
- Meet visa requirements
- Continue to meet relationship requirements
- Have no debts to the Australian government or have arranged to pay debts back
Visa Requirements:
Hold either:
- A Partner (Provisional) visa (subclass 309), or
- A Dependent Child (subclass 445) visa.
A minimum of 2 years must have passed since applying for the combined 309 and 100 visa for assessment for the permanent visa. In certain cases, if in a long-term relationship or the sponsor held a specific visa before applying, the permanent visa may be granted in less than 2 years.
Continue to Meet Relationship Requirements:
You must remain the spouse or de facto partner of the same person who sponsored you for the temporary Partner visa. Key requirements include being married or in a de facto relationship, maintaining a genuine and continuing relationship, living together or not living permanently apart, and being mutually committed to a shared life excluding other partners. Even if the relationship breaks down or the partner dies before the permanent visa is granted, you may still be eligible.
