Sponsored Parent Visa (subclass 870)
For those PRs who desire their parents to remain with them and for parents who have only been seeing their children for a few days, the Australian government and its department of home affairs have some good news to share for this fiscal year. You can now stay with your family for a longer period of time than with a visitor visa thanks to new laws that were published on March 1, 2019.
The sponsorship period begins on April 17, 2019, and the sponsored parent may apply for a visa on July 1st, 2019, if their application is granted.
(Subclass 870) Sponsored Parent (Temporary) visa
This temporary visa lets a parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen visit Australia for up to 3 or 5 years.
Eligibility Requirements:
To qualify for this visa, you must:
- Be the biological, legal (including adoptive) parent, step-parent, or parent-in-law of the Parent Sponsor.
- Be at least 18 years old.
- There are no balance of family test or Assurance of Support requirements for this visa.
Sponsorship:
You must have an approved Parent Sponsor to apply for this visa. Ensure compliance with any previous visa obligations.
Health and Character Requirements:
Meet the health and character requirements stipulated by the Australian government.
Financial Capability:
Demonstrate that you have or can access sufficient funds to support yourself during your stay in Australia.
Temporary Stay Intentions:
Intend to stay temporarily in Australia and engage only in activities permitted by the visa. If you’ve applied for a permanent parent visa, you may visit Australia during the processing period but cannot stay permanently.
Visa Privileges:
- Reunite with children.
- Visit Australia for up to 3 or 5 years per visa.
- Reapply for further Sponsored Parent (Temporary) visas, accumulating a maximum of 10 years in Australia.
- Employment is not permitted while holding this visa.
Duration of Stay:
This is a temporary visa with an initial validity of up to 3 or 5 years. The specific duration is determined on a case-by-case basis, considering factors such as your desired stay period and the sponsorship cessation date.
Cumulative Maximum Stay:
You can stay for a cumulative maximum of 10 years. However, you cannot extend this visa for a longer stay. To remain in Australia, you must apply for a different visa type.
Stay Extension Requirements:
To be eligible for another Sponsored Parent (Temporary) visa, you must spend at least 90 days outside Australia unless you have Permission to Apply in Australia.
Stay Beyond 10 Years:
If you have held Sponsored Parent (Temporary) visas for the maximum 10-year period, you must either leave Australia or apply for a different visa allowing continued stay.
Cost:
The visa cost is from AUD5,735 for up to 3 years or AUD11,470 for up to 5 years. Payment is divided into two instalments.
